Once a reconsideration has been filed, all efforts by the Social Security Administration to recoup overpayments must cease.

Social Security overpayments can sometimes be waived by the Social Security Administration if:

  • The beneficiary was without fault and is unable to repay without risking the ability to provide for basic needs, OR
  • Recovery of the overpayment would be unfair and against good conscience.
